Welcome to Funart. By accessing or using our mobile application ("App") and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").
Please read this agreement carefully before using our Services. Your continued use of Funart indicates your full acceptance of these terms. If you do not agree to all the terms and conditions outlined herein, you are not authorized to use the Services and must cease use immediately.
1. ACCESS TO THE SERVICES
Subject to the terms and conditions of this Agreement, Funart ("We," "Us," or "Our") provides AI-driven photo editing and artistic transformation services for your personal, non-commercial use.
Eligibility & Children's Safety: You must be at least 18 years of age (or the minimum legal age required in your jurisdiction) to access or use the Services. Funart maintains a Zero-Tolerance Policy regarding the safety and privacy of minors; therefore, you are strictly prohibited from uploading, generating, or sharing any photos or content featuring individuals under the age of 18 ("Minors"). If we discover that you have uploaded imagery of a Minor, we reserve the right to immediately terminate your account and delete all associated data without prior notice. Furthermore, Funart reserves the right to report any suspected illegal content involving Minors to the relevant law enforcement authorities or organizations, such as the National Center for Missing & Exploited Children (NCMEC).
Modifications to Services: We reserve the right to change, suspend, or discontinue any part of the Services at any time—including the availability of any AI style, effect, tool, or content—without prior notice or liability.
Service Availability: While we strive for 24/7 availability, Services may be interrupted for maintenance, upgrades, or emergency repairs. You agree that Funart will not be liable for any suspension, discontinuance, or lack of availability of the Services or any loss of your User Content.
Usage Limits: We retain the right to impose limits on certain features or restrict your access to parts or all of the Services at our sole discretion, with or without notice.
2. OWNERSHIP OF SERVICES AND CONTENT
All materials displayed or performed within the Services—including but not limited to AI effect designs, unique art styles, visual filters, photographs, illustrations, and software (collectively, "Content")—are the property of Funart and/or its licensors and are protected by international copyright and intellectual property laws.
Proprietary Rights: All trademarks, service marks, and trade names are proprietary to Funart. You shall abide by all copyright notices and restrictions contained in any Content accessed through the Services.
Usage Limits: You may download or copy the Content for personal, non-commercial use only. Any other use, including copying, distributing, or creating derivative works of our proprietary art styles or code, is strictly prohibited without our prior written consent.
Prohibited Replication: You shall not use the Services to replicate our functionality, create competing products, or gather data to train neural networks or other AI models.
3. USER CONTENT AND AI OUTPUTS
You are solely responsible for the content you upload, post, or generate through the Services ("User Content").
Your Ownership: As between you and Funart, you own and retain all rights, title, and interest in and to your User Content, including the prompts you submit and the resulting images generated by our AI features.
License to Funart: By using the Services, you grant Funart a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, copy, cache, and display your User Content solely for the purpose of providing, operating, and improving the AI generation services specifically for you. This license is limited to the technical processing required to transform your photos and ensure the Services function correctly. As Funart does not feature a public community or sharing platform, we do not use your User Content for marketing or promotional purposes without your explicit additional consent.
Content Warranties: You represent and warrant that you have the necessary rights to grant this license and that your User Content does not infringe upon any third-party intellectual property or privacy rights.
AI Nature Acknowledgment: You acknowledge that due to the nature of generative AI, the outputs generated for you may not be unique and other users may occasionally generate similar artistic results.
4. USAGE RESTRICTIONS & PHOTO GUIDELINES
You are entirely responsible for your conduct and any data (including photos of yourself or others) that you upload to Funart.
Consent for Human Portraits: If you upload a photo of a real person, you represent and warrant that you have obtained the explicit consent of that individual (or their legal guardian) to process their image using our AI technology.
Prohibited Content: You agree NOT to use the Services to upload, generate, or share any content that:
1. Involves Minors: Contains any imagery of individuals under the age of 18, regardless of the nature of the content or whether consent was obtained.
2. Is Non-Consensual or Intrusive: Infringes on any third party's intellectual property, privacy, or publicity rights, including but not limited to creating AI transformations of others' likenesses without their explicit legal consent.
3. Is Harmful or Explicit: Is sexually explicit, pornographic, lewd, violent, or promotes self-harm or illegal activities.
4. Is Malicious or Abusive: Is intended to harass, stalk, bully, or defame any individual, or contains malicious code, viruses, or any routine intended to damage our systems or data security.
Strict Enforcement: Funart utilizes automated tools and human review to identify and block content that violates our child safety policies. We reserve the right to report any suspected Child Sexual Abuse Material (CSAM) to the National Center for Missing & Exploited Children (NCMEC) or relevant law enforcement authorities.
Safety & Compliance: We reserve the right (but have no obligation) to remove any User Content or terminate accounts that we believe violate these restrictions or applicable laws.
5. SUBSCRIPTIONS AND PAYMENTS
Funart offers premium features through auto-renewing subscriptions.
Billing: Payments will be charged to your Apple ID / iTunes Account at the confirmation of purchase.
Auto-Renewal: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Refund Policy: All transactions and payments are managed exclusively by Apple via the App Store. Consequently, all refund requests must be directed to Apple Support, and any refunds granted will be subject to Apple's standard terms and conditions. Funart does not have the technical authority or legal access to process, approve, or issue refunds directly. Please note that except as required by applicable law or Apple’s specific policies, subscriptions and purchases are generally non-refundable by the developer.
6. WARRANTY DISCLAIMER & AI LIMITATIONS
The Services, AI-generated results, and all associated content are provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied. Funart expressly disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, nor do we guarantee that any results obtained from the use of the Services will be accurate, reliable, or free of viruses and other harmful components. You acknowledge that you use the Services and download any content at your own risk.
Furthermore, you recognize that AI-generated art is inherently subjective and produced through complex algorithmic processes. Funart makes no guarantee that the results will meet your personal expectations, be aesthetically pleasing, or be free from digital artifacts, distortions, or errors. The nature of AI means that similar prompts or inputs may yield different results, and we are not responsible for the perceived quality or artistic merit of the generated output.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Funart, its directors, and employees shall not be liable for any:
· Indirect, incidental, special, or consequential damages.
· Loss of profits, data, user content, or other intangible losses.
· Unauthorized access to or use of your photos/data resulting from factors beyond our reasonable control.
· Defamatory or illegal conduct of any third party or other users.
8. INDEMNITY
You agree to defend, indemnify, and hold harmless Funart and its affiliates from and against any claims, damages, obligations, losses, or expenses (including reasonable attorneys' fees) arising from: (i) your use of the Services; (ii) your violation of these Terms; or (iii) your violation of any third-party rights, including copyright or privacy rights related to the photos you upload.
9. ACCESS AND DEVICE SECURITY
Funart provides its Services without requiring a user registration or account system. Your access to the Services, including any premium subscriptions or features purchased, is tied directly to your Apple ID and your specific device. You are solely responsible for maintaining the security of your device and your Apple ID credentials. Funart disclaims any liability for unauthorized use of the Services or loss of access to premium features resulting from your failure to safeguard your device or if your Apple ID is compromised. You acknowledge that if you delete the App or lose access to your Apple ID, certain locally stored data or session-based preferences may be irrecoverable.
10. TERMINATION
· By You: You may stop using the Services and delete the App at any time.
· By Us: We may suspend or terminate your access to Funart immediately, without prior notice, if you breach these Terms.
· Survival: All provisions which by their nature should survive termination (including ownership, indemnity, and liability limits) shall remain in full force.
11. PRIVACY POLICY
Your privacy is paramount. By using the Services, you consent to our data practices as outlined in our full Privacy Policy. Notably, Funart maintains a strict policy against the collection of data on Minors: we do not intentionally process, analyze, or store biometric data or facial features of individuals under the age of 18. Any image identified by our systems or personnel as containing a Minor will be immediately flagged and permanently deleted from our servers to ensure maximum protection of child privacy. Please refer to our complete Privacy Policy to understand how we process, store, and protect all other User Content and personal information.
12. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in that jurisdiction.
13. MISCELLANEOUS
Entire Agreement: These Terms (and the Privacy Policy) constitute the entire agreement between you and Funart.
Severability: If any provision is found to be invalid or unenforceable, that provision will be limited to the minimum extent necessary, and the remaining provisions will remain in effect.
