This Privacy Policy explains how Funart ("We", "Us", or "Our") collects, uses, and protects your information when you use our mobile application and related services (collectively, the "Services"). Your privacy is our priority, and we are committed to processing your data with transparency and security.
1. INFORMATION WE COLLECT
We collect information to provide and improve our AI-driven artistic services while maintaining a streamlined, no-registration experience. Since Funart does not require you to create an account or sign in, we do not collect personal identifiers such as your name or email address unless you voluntarily provide them when contacting our support team. We automatically log certain technical data to ensure the App runs smoothly and securely, which may include your IP address, unique device identifiers, device type, operating system, app version, and general usage statistics. This information is used solely for functional purposes, performance monitoring, and to prevent fraudulent use of our Services.
2. SERVICE DATA AND AI PHOTO PROCESSING
To use Funart, you must upload a photo or video for AI transformation. All photos are sent to our servers via an encrypted connection to protect your privacy during the transmission process. For users who do not share their results publicly, original photos and AI-generated results are automatically deleted from our servers after a limited period of time following the last interaction.
When you apply an AI effect, our server-side AI analyzes facial keypoints and silhouettes to apply the effect accurately. Crucially, our AI processing pipeline includes automated safety filters designed to identify imagery containing individuals under the age of 18 ("Minors"). Any content identified as featuring a Minor will be blocked from processing and permanently deleted from our servers immediately to ensure child privacy. We do not use data to identify any individual users, to create permanent facial templates, or for any purpose other than generating your artistic output.
3. LOCAL STORAGE AND IDENTIFIERS
We use standard local storage technologies and secure device identifiers to ensure the App's core functions operate correctly without requiring a user account. These technologies, such as Apple's built-in storage are used to recognize your device's subscription status and to temporarily remember your recently selected photos within the image picker for your convenience. We do not use tracking cookies or collect data to build user profiles for marketing purposes. You can manage app-related permissions through your iOS system settings, though please note that restricting these identifiers or clearing local data may reset your recently used image history or impact your ability to access premium features within the App.
4. HOW WE USE YOUR INFORMATION
We use your data solely to process your AI art requests and transactions, and to communicate with you regarding support. Furthermore, we use this information to maintain and improve the technical performance of our App and to assist with our internal product development.
5. DATA SHARING AND DISCLOSURE
We do not sell your personal information or images to third parties. We only share data with trusted service providers who perform cloud hosting or data management on our behalf under strict confidentiality agreements. We may also disclose information if required by a valid warrant, subpoena, or applicable law, or if Funart is involved in a merger or sale, in which case your data will continue to be protected under this policy.
Notably, in our commitment to global child safety standards, Funart reserves the right to share information with law enforcement or organizations such as the National Center for Missing & Exploited Children (NCMEC) if we detect User Content that involves the exploitation of Minors or other illegal activities. Such disclosure is conducted to fulfill our legal obligations and to ensure the safety and security of our services.
6. SECURITY MEASURES
We implement industry-standard security measures to safeguard your photos and personal data. While we use encrypted transmissions and secure servers, no method of electronic storage is 100% secure. We encourage you to use strong passwords and keep your account credentials confidential at all times.
7. YOUR RIGHTS AND DATA REMOVAL
Since Funart operates without a registration or account system, your usage history and preferences are stored locally on your device. You can exercise your right to data removal by simply deleting the Funart application from your device, which will clear all local storage and cached data. Regarding the photos uploaded for AI transformation, these are automatically deleted from our servers after a limited period of time as described in Section 2. Since we do not collect email addresses, social media profiles, or maintain public user galleries, there are no subscription lists, linked accounts, or public posts to manage or delete.
8. THIRD-PARTY SERVICES
Our App may utilize trusted third-party services for cloud hosting and payment processing (such as Apple's In-App Purchase system). These third parties have their own privacy policies, and while we only work with reputable providers, we are not responsible for their independent data practices. We do not display third-party advertisements or provide links to unrelated external websites within the App.
9. CHANGES TO THIS POLICY
We may update this Privacy Policy from time to time to reflect changes in our technology or legal requirements. If we make material changes, we will notify you by posting the latest policy within the App. We encourage you to review this policy periodically to stay informed about how we protect your information.
10. CHILDREN'S PRIVACY
Funart is strictly not directed at individuals under the age of 18 ("Minors"). We maintain a zero-tolerance policy regarding the collection of personal information, including facial biometric data and photos, from Minors. We do not knowingly process, analyze, or store any data related to Minors. If we become aware that we have inadvertently collected personal information or processed an image containing a Minor, we will permanently delete such data from our servers immediately.
